On May 23, 2015, police in Houston, Texas arrested 22-year-old Da Vonte McCardle after seizing a bottle containing suspected liquid codeine from him.




On September 29, 2015, McCardle pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to 15 days in the Harris County Jail.




On May 11, 2016, the Houston police crime laboratory tested the liquid and no controlled substance was found.




A report of the testing was sent to the Harris County District Attorney's conviction integrity unit, which notified McCardle's defense attorney and supported a defense motion to vacate the conviction.




On May 24, 2016, the motion to vacate was granted and the prosecution dismissed the charge.
