On May 14, 2015, police in Houston, Texas arrested 20-year-old Thomas Pham after confiscating what they believed was Lidocaine, an anesthetic.

On May 18, 2015, Pham pled guilty in Harris County Criminal District Court to a misdemeanor charge of possession of a controlled substance. He was sentenced to 10 days in the Harris County Jail.

Not long after, the Houston Police crime laboratory reported to the Harris County District Attorney's Conviction Review unit that tests were negative for the presence of a controlled substance.

The prosecution notified Pham's defense attorney and joined in a motion to vacate the conviction. On June 15, 2015, the motion was granted and the prosecution dismissed the charge.
